For all new buildings, an energy certificate (EC) is required already for the official building permit process. An energy certificate is also required for comprehensive renovations, extensions and conversions.
An EC must also be presented upon the sale, lease or rental of properties (houses, apartments, offices, etc.). The validity period of the EC is a maximum of ten years.
When selling a building, the seller must present the buyer, and when leasing a building, the lessor must present the lessee, with an EC that is at most ten years old at the time, well before the buyer's or lessee's contractual declaration is made!
The EC or a complete copy thereof must be handed over to the buyer/tenant within 14 days of the conclusion of the contract.
When an apartment, office or building is to be sold or rented/leased, advertisements are often placed in daily newspapers and/or on various real estate platforms. Pursuant to § 3 EAVG, the advertisement must state the heating energy demand (HWB) and the overall energy efficiency factor (fGEE) of the building or the unit of use. This obligation applies both to the seller or lessor and to the real estate agent commissioned by them. Failure to comply can be costly, as § 9 EAVG provides for the possibility of an administrative fine of up to € 1,500.
A real estate agent's violation of § 3 is excused if they have informed their client of the disclosure obligation under this provision and requested them to provide the two values or to obtain an energy certificate, but the client has failed to comply with this request.
On the part of the Federal Ministry, there is no defined institution that issues the energy certificate; several professional groups such as electricians, plumbers, architects and chimney sweeps, etc. have therefore taken on this task.
